By accessing the website, the user/buyer (“you”) indicate your unconditional acceptance of these Terms and Conditions. Scarlet Ruby Interiors reserves the right to update or revise these Terms of conditions. Your continued use of this website, following the following posting of any changes to this website, constitutes acceptance of those changes. When you purchase items in this website, you enter into a binding agreement with Scarlet Ruby Interiors which is binding by these Terms and Conditions. Should you not agree to any of these terms and conditions, you are to immediately cease using the website or online platform.

All Rights Reserved and no portion of this website may be copied, reproduced, transmitted, derived, or otherwise used for any purpose, other than browsing the website and placing an order with Scarlet Ruby Interiors, without the prior permission of Scarlet Ruby Interiors.


Customer Privacy Policy

Scarlet Ruby Interiors shall take all reasonable steps to protect the personal information of users/buyers. All the information gathered in the online forms on the website is used to personally identify users that subscribe to this service. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment Options

All transactions will be processed in South African Rands (ZAR). Payment may be made via Visa, Master Card, or by electronic transfer into the Scarlet Ruby Interiors bank account, the details of which will be provided on request. Confirmation of payment must be provided. Your order will only be dispatched after payment, in full, has been received.


Security

Scarlet Ruby Interiors uses PayFast to provide a secure environment for the authorisation of payment. Confidential information, including card/banking details, is encrypted using industry standard encryption technology.


Products and Availability

Please note that stock of all items on offer at www.scarletruby.co.za is limited. Scarlet Ruby Interiors will make all reasonable attempts to ensure that special offers are brought to an end when stock runs out. If it happens that Scarlet Ruby Interiors is unable to fulfill any order at the advertised price due to stock being sold out, Scarlet Ruby Interiors will let you know and you will be entitled to a reimbursement for the rand value you have paid for such product(s). While Scarlet Ruby Interiors.com endeavours to maintain reasonable amounts of stock available to consumers, it cannot guarantee the availability of any items listed on the website or online platform. Scarlet Ruby Interiors.com, shall at all times exercise reasonable care in ensuring that the pricing of goods on the website and online platform is accurate and up to date. However, Scarlet Ruby Interiors.com shall not be liable to consumers, retailers, or users of the website or online platform in the event of pricing errors due to system malfunction, human error or otherwise.

The website, www.scarletruby.co.za , allows buyers to place electronic orders for one or more products on offer as long as such products are available and not sold out.

A purchasing contract (“sale”) between a buyer and Scarlet Ruby Interiors only comes into effect once the buyer has fully completed and submitted the online order form for one or more products in the buyer’s shopping cart (basket) and the payment has been authorised by Scarlet Ruby Interiors or has been received into Scarlet Ruby Interior’s bank account. Once an order has been confirmed, the onus remains on the User to ensure the correctness of the order and that the appropriate sizes, colours and types have been selected.

Products on www.scarletruby.co.za cannot be reserved to be bought at a later stage. Placing an item into your shopping cart (basket) without completing the order does not amount to a sale or an order.


Returns Policy

In terms of Section 44 of the Electronic Communications and Transactions Act of 2002 (ECTA), the buyer (“you”) have a seven-day cooling-off period during which you may return goods to Scarlet Ruby Interiors. In the event that you do return the goods, you will be liable for the return courier fees.

Scarlet Ruby Interiors will not accept returns:

  1. The consumer protection act (the “CPA”) specifically excludes “buyer’s remorse” and Scarlet Ruby Interiors reserves the right to reject returns that are sought because the consumer has “changed his mind” or no longer wants the item after the purchase has been made
  2. Where the goods have been damaged due to ordinary wear and tear or worn out in the ordinary course of use.
  3. Where the goods have been purchased from other retailers and not Scarlet Ruby Interiors.
  4. Where the goods fall into one of the following categories:
    • Underwear, sleepwear or lingerie
    • Goods that have been personalised or custom made
    • Goods that have been specifically ordered for the Consumer and are not in ordinary stock
    • Goods that may pose a health or safety hazard if returned or reused.
    • Earrings, including studs, piercings, hair pieces, attachments and other personal body items due to health and safety considerations.
    • Electronic goods, where such goods have been opened, tested or used due to the nature and sensitivity of electronic components.
  5. Where goods have been incorrectly supplied. an example of this is where a user orders goods and receives goods that are substantially different from what was ordered. Scarlet Ruby Interiors will then have the incorrect goods picked up and the correct goods delivered at no charge to the consumer.
  6. Where the goods sold are materially defective. materially defective means that the goods are not suitable for the purposes for which they are made or designed and that the defect affects the usage of the item. Scarlet Ruby Interiors reserves the right to inspect the goods once they have been returned before offering the consumer recourse on the matter, which will include;
  7. Where the goods have been willfully damaged or have been damaged by the gross negligence of the consumer or retailer. Where the goods have been damaged by force majeur, or an act of God such as inclement weather, natural disaster, power failure, electrical surges or circumstances outside of Scarlet Ruby Interiors’ control.
  8. Scarlet Ruby Interiors reserves the right to hold the consumer liable for delivery charges in the event of one or more of the above circumstances being the reason for return of the goods.
  9. Cash refunds will be processed 7 (seven) to 14 (fourteen) working days from date of refund being accepted and return validated. Refunds shall be made to the banking details from which the order was placed, or to the banking details provided to Scarlet Ruby Interiors on signing up or account creation.
  10. Returns are only applicable to customers within South Africa
  11. Any exchanges are at the consumers cost
  12. If a customer requests Cash refund and the basket value drops below the Free Transport or Promotion validation price, Then the customer is liable for any charges deemed by Scarlet Ruby Interiors (Pty) Ltd
  13. If a customer requests store credit and the value of the order drops below the Free Shipping total. We will issue you store credit less the shipping fee that was liable.

If the item sent is not a product purchased at Scarlet Ruby Interiors then the customer is liable for all the transport charges that has and will occur.

  1. Cash refunds that are requested after the 15th of December each year shall only be processed after the 15thof January that succeeding year as the admin accounts of Scarlet Ruby Interiors are closed during this period.

Refund Policy

Scarlet Ruby Interiors understands that you may want to return your purchase. In terms of Section 44 of the ECTA, you may cancel the transaction within seven days of receipt thereof. In such a circumstance, you need to arrange the return of the goods by means of a door-to-door courier. We highly recommended that you use a courier with a twenty-four-hour tracking facility and insure the parcel for safe return. You will be liable for the costs of the return. Goods returned must be in their original packaging and must not have been used or damaged. Goods must be accompanied by the original invoice.


CANCELLATION POLICY

The Consumer may at any time prior to the order being finalized and confirmed online via completion of the transaction, cancel the order at no charge to him or her. Once the order has been confirmed and finalised, however, Scarlet Ruby Interiors reserves the right to charge a reasonable handling or administrative charge which may be up to 10% of the purchase price of the goods in accordance with the Consumer Protection Act (the “CPA”) Scarlet Ruby Interiors reserves the right to cancel any order where there is suspicion of fraud, misconduct or other criminal activity and to refuse the supply of goods in such circumstances. The Consumer may not unilaterally cancel the transaction, subject to the terms of the Returns Policy in Clause 7 above. All cancellation of orders must be done in writing from the account holder related to the purchase and refunds shall take 7-14 working days to process. If cancellation is done after an order has been shipped, the customer shall be refunded only once the order has been returned and validated in the warehouse at Scarlet Ruby Interiors and that account holder may be liable for shipping charges.

Scarlet Ruby Interiors will not be held responsible for items that are damaged in transit or not insured before being sent back. You will receive a full refund once the goods have been received back in good order.


Defective or Damaged Goods

Scarlet Ruby Interiors urges you not to accept delivery of any item which is visibly damaged. Should you only discover the damage after the courier has left, you must report this to Scarlet Ruby Interiors within twenty-four hours and we will arrange for the product to be collected from you, and have it exchanged as soon as possible. We will inspect all goods returned and check them as defective or damaged. In the event that we find no fault, we reserve the right to recharge you for the goods and to recover our fees and expenses from you.


Incorrect Product

If the incorrect product is delivered to you, please do not remove it from its original packaging, open or use it in any way. Please urgently notify Scarlet Ruby Interiors thereof in order for us to resolve the mistake by arranging for the collection of such merchandise from you and deliver the correct merchandise to you as soon as possible. Please contact us within twenty-four hours of receipt of the incorrectly delivered merchandise.


Delivery/Shipping of Merchandise

Scarlet Ruby Interiors will make every effort to ensure that your parcel (“order”) is ready for collection and delivery as soon as possible. Please allow up to six working days, after receiving a “processed” email, for delivery of your order. Scarlet Ruby Interiors relies on delivery agents for the delivery of its merchandise and cannot be held responsible for late delivery for reasons beyond its control.

Please ensure that your address details are correct – an 8am to 5pm, Monday-Friday address should be provided – and note that we cannot deliver to PO Box numbers. If the courier is unable to deliver due to incorrect information given or recipient not being available to receive goods, a re-delivery fee of R100.00 will be charged to the recipient by Scarlet Ruby Interiors. You will be provided with a tracking number upon dispatch of your order (when receiving a "Shipped" email) to enable you to track your parcel. Courier charges are subject to change without notification. No deliveries shall be made to P.O Boxes or LOT No’s or outlying areas which are not accessible by delivery companies. The onus remains with the Consumer to ensure that an accessible physical address is provided.


Errors

While Scarlet Ruby Interiors will make every effort to ensure that prices on its website are accurate, errors may occur.  If we discover an error in the price of products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.  If you cancel your order and you have already paid for the items, you will be refunded in full.


Disputes

In the event of any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this agreement, such a dispute shall be submitted to confidential arbitration in terms of the expedited rules of the Arbitration Foundation of South Africa.


Liability

Neither Scarlet Ruby Interiors nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature, arising from the use or inability to use any product sold on this website.
